1985年国籍法と沖縄の「無国籍児」問題 : 「排除」と「包摂」のはざまで

要旨

In the modern Japanese history, Okinawa has always been marginalized: sometimes excluded from the nation-state, and sometimes included into it by the Japanese government. In this paper, I will explore its logic of which the Nation-State takes possession when it decides the membership of Nation, through the process of the revision of the Nationality Law in 1985, according to ratification upon the Convention on the Elimination of All Forms of Discrimination against Women. Supported by the women’s movement, it legitimates that children born between a Japanese mother and a foreign father acquire Japanese nationality as well as their counterpart. Although gender equality among Japanese parents got realized in the law, there still remained some problem: it did not apply to the stateless children born before 1965 in Okinawa, those who were eager to get Japanese nationality because of the effect only for them born after 1965; By analyzing this process, from multiple perspective, I will rethink historically of citizenship(nationality) in Japan　and how the State traced draws a boundary of the Japanese at that moment, final\ ly reevaluate of the Japanese Nationality Law.
