要旨(Abstract) 日本語 介護福祉士は「人を支える専門職」であると同時に「労働者」でもある。しかし本稿は、介護福祉士という資格が独立した学問体系として成立したものではなく、医学・看護学・社会福祉・リハビリテーション・行政などの複数分野から各領域の知識を選択的に援用して複合的に構成された多分野複合型の資格であるという仮説を提示する。その帰結として、資格教育は「ケアの学問(人を支える学問) 」を多く取り込んだ一方で、 「労働の学問(支える側を守る学問⸺安全衛生・労働衛生・労働時間規制・休暇等の権利保障・ハラスメント防止・安全配慮義務を含む労働法一般・事業継続を含む) 」を出自として欠いている。 養成課程・出題基準を一次資料で検証した結果、 「介護従事者の安全」に相当する項目は完全に不在なのではなく、独立した領域・科目としての地位を一度も得ないまま、利用者向けケアを扱う科目の内部に従属的な一項目として置かれ、その内容も「業務遂行能力の維持」を上位基準とする範囲に選択的に偏っていることが確認された。同様の非対称は法制度のレベルにも見られる。利用者向けの安全配慮義務は判例上の契約責任と介護保険法の運営基準(省令)という二重の裏付けを持つのに対し、労働者向けの安全配慮義務は労働契約法第5条という抽象的な一条文にとどまり、介護従事者に特化した具体的な行政規制を欠く。さらに、判例が要求する専門的説明・説得義務は、しばしば「自己決定の尊重」という介護理念と方向的に緊張し、その緊張が現任研修の場で選択的に素通りされる事例も観察された。 本稿はこれらの学問的非対称を論点として整理し、現場で観察される諸問題(無理なシフト、欠勤の評価化、有給休暇の時季指定権の侵害〔シフトへの事前組み込み・欠勤の有休振替〕 、業務集中、BCPの二重性〔利用者向け/職員向けの非対称〕 、夜勤中の職員急変対応マニュアルの不在、36協定の特別条項の恒常的運用、ハラスメント防止研修が努力義務・例示的手段にとどまる制度設計)が、個人の資質や管理能力の問題ではなく、資格の学問的出自に由来する構造問題として説明できることを示す。なお本稿は、この非対称の問題を「単一の正解となる基準(操作的定義)が存在しないこと」として捉えるのではなく、「個別事情の中で収束的に妥当な判断(正確さ)を養うための体系的な訓練機会が用意されていないこと」として捉え直す視点も提示する。 English A certified care worker (kaigofukushishi) in Japan is simultaneously a professional who supports others and a worker who must themselves be protected. This paper advances the hypothesis that the certified care worker qualification did not emerge from a single, pre-existing academic discipline but was instead assembled as a multidisciplinary composite, selectively drawing knowledge from medicine, nursing, social work, rehabilitation, and public administration. A consequence of this genesis is that the qualification’s curriculum extensively incorporated “the science of care” (knowledge oriented toward supporting the person being cared for), while never acquiring, as part of its disciplinary origin, “the science of labor” — the body of knowledge and law oriented toward protecting the person providing care, including occupational health and safety, working-time regulation, leave entitlements, harassment prevention, the employer’s duty of care, and business continuity. Verification against primary sources — the examination guidelines and the curriculum-designating ministerial ordinance — shows that content corresponding to “the safety of care workers” is not entirely absent. Rather, it has never been granted independent status as a domain or subject; it exists only as a subordinate item nested within a subject devoted to user-directed care, and even its content is selectively skewed toward items justified by “maintaining the capacity to perform one’s duties” rather than by the worker’s own health as an end in itself. An analogous asymmetry appears at the level of the legal system: the duty of care owed to service users rests on a double foundation — case-law-derived contractual liability plus concrete ministerial-ordinance obligations under the Long-Term Care Insurance Act — whereas the duty of care owed to workers rests solely on the abstract single provision of Article 5 of the Labor Contract Act, lacking any care-sector-specific administrative regulation.Furthermore, the explanatory and persuasive duty that case law imposes on care providers frequently runs in tension with the care philosophy of “respecting self-determination, ”and this tension was observed to be selectively skipped over in in- service training. The paper organizes these epistemic asymmetries and shows that a range of problems observed on the ground — unsustainable shift schedules, the punitive treatment of absences, infringement of the worker’s right to designate the timing of paid annual leave (through pre-emptive scheduling of leave and the after-the-fact conversion ofabsences into leave), the concentration of duties on licensed staff, the dual and asymmetric structure of business continuity planning (user-facing versus employee-facing), the absence of any response manual for a worker’s sudden medical emergency during a night shift, the routinized use of the “special clause” exception under Article 36 agreements, and a statutory design in which har
