Ambient Computing Law

要旨

Abstract This entry discusses the legal framework of data protection in relation to the sociotechnical infrastructure of ambient computing. Starting from earlier conceptions such as ubiquitous computing and ambient intelligence, the entry detects the key techniques and technologies of adaptive environments, highlighting the need to distinguish three types of data (volunteered, observed, and inferred) before providing an analysis and comparison of EU and US data protection regimes in relation to ambient computing. Finally, the entry confronts the radically different background of data protection in Japan, calling attention to the early uptake of research into smart environments within Japan, pointing out unfamiliar but nevertheless singularly relevant conceptions of privacy in the Japanese context.
